Alan Tsui, a partner at JunHe Law Offices, has been selected as one of Asia's top-notch lawyers in ALB's 2023 Super 50 Disputes Lawyers list. Tsui is known for his outstanding legal expertise and client-centred approach.

 

Can you share some of your most notable practice highlights from the past year? What were some of the key cases or achievements that stood out for you as a disputes lawyer?

I am a disputes lawyer specialising in commercial and company disputes, civil fraud investigations of listed companies, insolvency, enforcement of securities, and employment disputes. I have also represented corporate clients across various industries, including companies, banks and individuals navigating complex cross-border disputes. In court or during arbitration proceedings, I have obtained interim relief, including injunctions, on behalf of his clients numerous times against shareholders, directors and debtors for breach of agreement or fiduciary duties, and eventually obtaining final judgements/awards.

I got extensive litigation experience, including representing well-known PRC securities firm to settle a private bond dispute of over $25,000,000, including enforcing HK Listco shares as charged securities, representing well-known PRC securities firm to act against an international bank for a basket bond product investment dispute of over $63,000,000 and also representing one of the five biggest PRC banks to claim for repurchase of subscribed shares worth over HK$200,000,000 under an offshore fund subscription agreement and debt of over HK$300,000,000 under a facility agreement etc.

Over the years, I have had the opportunity to work on a range of challenging cases. A few achievements that stand out for me are successfully representing clients in complex litigation matters and working on several cross-border disputes. These cases can be particularly complex; it is my job to help my clients navigate the legal system and achieve the best possible outcome.

What guiding principles or strategies do you employ in your cases to effectively represent your clients and navigate the intricacies of the legal system?

I firmly believe that effective representation requires a combination of legal expertise, strategic thinking, and strong communication skills. One of the guiding principles that I employ in my cases is to always put my clients’ interests first. This means taking the time to understand their needs and developing a strategy tailored to their specific situation. In addition, it is important to be proactive and responsive in our communication with clients, keeping them informed of developments in their case.

What have been some of the evolving trends and developments in the disputes space in your jurisdiction? How do you stay ahead and ensure success for your clients?

Hong Kong is hailed as an international arbitration hub because of its independent judiciary and unique status as a bilingual common law jurisdiction. Disputes space in Hong Kong so far has not been impacted by political developments in previous years. To stay ahead of the trend, we need to keep up to date on legal developments, including the changes in laws and regulations as well as new legal precedents, which help us to anticipate potential issues for our clients.
