Indonesia is Southeast Asia’s larg-est economy, and a key market for Japanese investment. Their presentation will cover, among other things, Law Number 11 of 2020 concerning Job Creation which has been amended several times, most recently with Law Number 6 of 2023 (known as the Job Creation Law). “One of the impacts of this law is to provide opportunities for foreign investors to freely invest through the FDI scheme in various business fields in Indonesia,” says Situmorang. She adds that as a derivative of the Job Creation Law, Presidential Regula-tion Number 49 of 2021 was issued and regulates that foreign entities can control up to 100 percent of shares for all business fields apart from the Positive Investment List. This has had a significant impact. “According to the data from the Ministry of Investment/Investment CoordinatingBoard(BKPM),FDI received until the third quarter of 2022 was not only higher than domestic investment, but with year-on-year growth of 63.6 percent, it was the highest in history,” says Situmorang. However, investors still face challenges. “One of the main challenges for any foreign investors to invest in Indonesia is the ongoing relocation of the national capital city, also known as the the Nusantara Capital City Project, or IKN Project,” says Situmorang. “To facilitate foreign investors for doing business, certainty, opportunity, and greater participation for foreign business actors in the private sector to accelerate the development of new capital, the government has issued various laws and regulations such as the Government Regulation No. 12 of 2023 on the Granting of Business Licenses, Ease of Doing Business, and Investment Facilities for Business Actors in the Nusantara Capital.” The ALB General Counsel Luncheon: Investing In Asia 2023 event will be held at Hilton Tokyo on Oct. 19.
