Data protection and privacy are crucial issues for public and private sector organisations around the world. Often, international business requires compliance with two or more distinct legal and regulatory regimes governing data processing and transfer. Breach, even inadvertent breach, can result in extremely significant penalties and enforcement action. Under the EU's General Data Protection regime (GDPR), those penalties can amount to €20 million or 4% of global annual turnover (if higher). Recent enforcement actions have included the imposition of a €50 million penalty by the French data regulator. Significant penalties can also be incurred under other data protection regimes, including the first fine of $50,000 imposed in 2016 under Singapore's Personal Data Protection Act 2012. With new data protection regimes in effect or in progress, including those enacted in California and Brazil, and under consideration in India, cross-border compliance is a pressing business issue.
This Masterclass examines practical compliance measures through discussion of an extremely realistic case study, drawn from recent practice. The case study involves an organisation based in Singapore with customers and suppliers in Europe and in the United States. We begin with a significant personal data breach, and work through the decisions that must be made, and the responses that must be put in place to deal with the breach. We will also identify the relevant notification procedures, engagement with regulators and redress for data subjects. By the end of an intensive and highly interactive day, you will have actionable checklists and materials to evaluate your own organisation's compliance and breach response procedures.

Malcolm Dowden is a Legal Director at Global 100 law firm Womble Bond Dickinson. Qualified in 1994, Malcolm is a UK-based solicitor with extensive experience of law and legal developments relating to technology and electronic communications. In 2017 Malcolm contributed to and edited a ground-breaking report addressed to the UK government and published by Lord Holmes, a member of the UK upper legislative chamber. Following publication of that report Malcolm was invited to chair a legal working group to analyse and report on the legal and regulatory implications of blockchain and distributed ledger technology for government and the private sector. He also chairs the Supply Chain Working Group of the Accord Project, a collaborative international group of lawyers, technologists and business professionals seeking to develop techno-legal standards and open source software to support the development and adoption of smart legal contracts. Malcolm's previous ALB workshops have focused on the "internet of things". This new workshop is broader in coverage, and draws on the latest legal and technical developments and thought leadership to bring you up to date with developments in this rapidly moving and economically crucial area.
