Kuwaiti logistics firm Agility has filed a law suit against the U.S.-based Defense Logistics Agency – Troop Support (DLA) for breach of contract and is seeking $225 million in fees and interest, the company said in a statement on Tuesday. DLA Troop Support provides United States armed services members with food, clothing, textiles, medicines, medical equipment, and construction supplies and equipment.

The claim, which was filed at the Armed Services Board of Contract Appeals in Virginia, alleges that U.S. government officials employed by DLA and the Department of Justice  conspired to intentionally deprive Agility of performance-based fees that it was entitled to under the Second Prime Vendor Contract. Agility said under the contract it was entitled to distribution fees based on superior performance if it passed an objective evaluation by the Defense Supply Centre Philadelphia (DSCP) and was found to have met the listed requirements of achieving its targets for percentage of orders filled successfully.

Agility said its original positive evaluation was downgraded as the company became embroiled in separate legal matters with the U.S. government. “Had DOJ officials and others not interfered with Agility’s contractual rights and had the contracting officers fulfilled their independent contractual and regulatory duties, DSCP would have issued evaluations entitling Agility to nearly $158.9 million in additional distribution fee payments,” said Tarek Abdul Aziz Sultan Al Essa, Agility’s chairman and managing director in the statement.

In July, a U.S. appeals court ruled against an attempt by Kuwaiti logistics firm Agility to avert prosecution over charges it defrauded the U.S. Army in multibillion-dollar contracts.

Agility was the largest supplier to the U.S. Army in the Middle East during the war in Iraq. It has been accused of overcharging the Army over 41 months on supply contracts the government says totaled $9.8 billion. The case has been politically sensitive in both Kuwait and Washington.
